WRONGFUL ARREST

Posted by

Black Sea Law Company Team successfully released from wrongful arrest in Nikolaev Sea port on behalf of Charterer’s side! Hopefully, the Ukrainian Commercial court’s judge was very quick, well-educated, and clean-minded in her decision.

Article 6 of the Brussels Convention states that Ukrainian law is applicable to the wrongful arrest definition when the arrest procedure has been initiated in Ukraine. The Ukrainian Proceeding Law defines ship arrest as a preventive measure to get security on the claim. In the case of a ship arrest cancellation or the claim refusal, the party that incurred the loss that resulted from the ship arrest may apply to the court for reimbursement.

Our company already has deep experience in resolving disputes related to the wrongful arrest of ship or cargo in Ukrainian ports.

This is one more positive case to Black Sea Law Company professional profile!
